‘Children Used As Bargaining Tools’ Claim Woolley & Co Solicitors

A recent poll of 4,000 parents and children revealed that 68% of parents confessed to using their children as “bargaining tools” when they separated, 19% of children said they felt used and a further 38% of children never saw their father again following separation. In light of these shocking statistics, the family lawyers at Woolley & Co Solicitors are advising parents that divorce should not become a war of attrition.

Andrew Woolley, senior partner at Woolley and Co, who can help with divorce rights and getting a divorce says, “Agreeing where the children live and when the absent parent sees them (child residence and contact) should not become a war. The most important thing is what is in the best interests of the child.

“In an ideal world, all parents would be able to sort out the arrangements for their children in an amicable and sensible way when they separate, treating each other with respect and focusing only on what they want for their children. But when a relationship breaks down emotions run high and can get in the way of this.”

Where communication between a couple has broken down there is often little possibility of the parents agreeing on anything. Parents need to try and be objective, talk to people who can help them, perhaps a family member or friend, and focus on putting their children’s needs first.

By putting aside their differences and thinking about their children’s needs, parents can provide a way forward when discussing arrangements for the children. The arrangements need to be clear, consistent and reliable for everyone involved.

An alternative to agreeing arrangements for the children between yourselves is to ask a Judge to decide. This can involve costly legal fees, a long drawn out process and further heighten the emotions.

Your divorce lawyer will be able to discuss what is appropriate in your particular case but it is generally considered to be in children’s best interests to have a relationship with both parents, whether or not they live together. The arrangements must be safe for the child with each parent supporting and encouraging their children to enjoy a positive relationship with the other parent. Parents should not expose children to continuing conflict as this can cause emotional harm.

Always consider if there is any scope for compromise. Discuss and try to agree about important things which will occur in your children’s lives such as, choice of religion, schooling and medical treatment. Try to be responsible and reasonable with the other parent. Remember, both parents need to work together for the benefit of their children, often for many years and it is therefore important to keep lines of communication open.

This does not mean giving them responsibility for making adult decisions but it does mean asking about their worries, what matters to them and if something is happening that they do not like.

Even living some distance apart from one of the parents does not mean the children cannot continue to have a relationship with both parents. Use can be made of the telephone, cards, letters, texts or e- mail. It is also important for children to keep in touch with other important people in their lives such as wider family members and close family friends.

Family Law Firm Expands in Warwickshire

Specialist family law firm Woolley & Co has further expanded it’s presence in the midlands with the appointment of family solicitor, Sharon Brassington.

Sharon, who joined family law specialist Woolley and Co in October, will work from her base in Bulkington, Warwickshire covering clients across Coventry and Warwickshire.

Sharon attended Nuneaton’s Nicholas Chamberlaine School, in Bedworth, before heading to North London University and the then York College of Law. She had decided at the age of 14 that she wanted to work with the law and the majority of her training involved working in the area of family law which is why she decided to specialise.

Sharon from the firm who specialise in divorce, family law and financial settlements, said, “It was something I really enjoyed. I found it much more interesting than wills and probate and conveyancing. Family law is about meeting all kinds of people who are in difficult circumstances. My role is trying to be a lot of things to that person - not just a lawyer, but an advisor and a confidant. You give legal advice but also a lot of sympathy,” said Sharon, who is a fully trained collaborative lawyer, a member of the Family Law Panel and a member of Resolution.

Collaborative law is taking off in the UK after coming over from America. It encourages the parties, together with their legal advisors, to reach an agreement without having to spend the time, money and upheaval of going to court to thrash things out.

When a marriage breaks down and divorce is on the cards, one of the most popular questions on the minds of those involved is ‘what rights do I have’ and ‘what am I entitled to’. Getting the right advice to help you make the right decision and embodying those decisions in the appropriate legal documents is all important say family law specialists Woolley & Co Solicitors.

Andrew Woolley, senior partner from the firm which specialises in divorce, family law and financial settlements, said, “Most people would concur that agreeing amicably on the details of a divorce before going your own way is the best solution to a bad situation for all concerned.

“But however friendly the negotiations are, if you do not get the agreement sorted legally, it can leave the door open for an ex to make a claim years after you have both moved on.”

First of all you should ensure that a ‘Consent Order’ is in place to ratify the agreement you have come to, even if you manage to sort out the division of assets without going to court. A “consent order” is a Court Order by agreement of the people involved. A “clean break” is where both parties future claims are all cancelled normally after a once and for all settlement has been arranged. Clean breaks are often arranged by a Consent Order but a Consent Order is by no means always a clean break

Once an order has been agreed and lodged with the Court, it is legally enforceable. If properly drawn up it normally means that if one party, perhaps previously agreeable but now cheered on by a new partner, decides the settlement they got from the house was not fair, or they want a bigger chunk of the pension fund, they have no claim.

Cancelling any future claims with a clean break order is not possible in every case though and this is why it is essential that a client seeks advice from an experienced family lawyer before making any decisions.

For instance, if children are involved and ongoing support is an issue, a clean break is not always possible. The nature of the support may change over time and so a final order setting a settlement in stone is not appropriate.

Where agreement cannot be reached on the division of assets or one person will not agree to the terms the couple can ask the Courts for a decision.

It is not easy though and issues like children can make it almost impossible. Because of the necessity of an ongoing flow of financial support, a clean break Order will not be appropriate,

Then there are situations where an order could be achieved but one party will not agree to it. This might not necessarily be because they have any intention of claiming in the future, but simply because they want to unsettle the other party. In cases such as these a judge will decide the issue.

“Clean break orders are becoming more popular, because people are becoming more aware of them, but it is perhaps with older generations where they come into play most often. They will have no dependent children and a significant pot of assets which can be divided cleanly and a line drawn under proceedings.”

Woolley & Co Dispels Child Maintenance Myths

In society today, it is quite common for relationships, marriages and civil partnerships to breakdown. Arguably, one of the most emotionally challenging aspects as a result of this is how to deal with the children, in addition to the issues surrounding child support. Leading family law firm, Woolley and Co, explains important aspects concerning child maintenance.

The Child Maintenance and Enforcement Commission (CMEC), formerly known as the Child Support Agency (CSA), was introduced in the early 1990s. It is a new Non-Departmental Public Body, introduced to take responsibility for the child maintenance system in Great Britain. The change from CSA to CMEC is in place to ensure that parents who are separated or going through divorce understand their responsibilities and take appropriate action to provide financially for their children.

CMEC aims to promote the financial responsibility that parents have for their children, in addition to ensuring the appropriate information, guidance and support on the different child maintenance options is available. Additionally, CMEC aims to provide an efficient statutory maintenance service, with effective enforcement.

The courts no longer have a significant amount of power to deal with maintenance for children. Courts can now only make maintenance orders for children in a limited number of cases, such as where a child is disabled and there are care costs, where a child is in full-time education and there are school fees to pay and even where the other parent lives abroad on a permanent basis.

Once CMEC has made an assessment, there is very little lawyers can do. If the payee or payer think the figure CMEC has decided upon is wrong, CMEC can take action, by hearing a form of informal appeal or by taking the non-payer to Court.

However, CMEC does face some restrictions. For example, the organisation is unable to deal with maintenance issues for children over the age of 17 who are not in full-time secondary school education.

Instead, it would be advisable to contact the National Association for Child Support Action (NACSA), which can help parents to address any issues or difficulties that arise while dealing with CMEC.

“If your relationship is breaking down, discussing the impact on children, including issues such as child maintenance, should be at the top of your list, as the earlier a mutual agreement is decided, the easier the process is likely to be.”

Cultural Differences In Divorce Cases

In our culturally diverse society, family lawyers are regularly called upon to help with issues surrounding divorce in other countries or concerning other religions. This is a highly specialised area.

It is essential to use a divorce lawyer experienced in working with a particular religious denomination and the intricacies of international divorce law. Talaq is the term used to mean divorce in accordance with Islamic rules. Under traditional Islamic Law, a bare Talaq divorce takes place when the husband pronounces three times: ‘I divorce you.’ Such a pronouncement has the effect of dissolving the marriage instantly, however, this is not enough to satisfy the UK courts.

The Get (Hebrew word for the divorce document) is also common in the UK. Jewish law applies to a Jewish person no matter what country they live in and if a Jewish couple divorce under UK law but not under Jewish law, it means they are still married in the eyes of the Jewish faith which clearly can be very important in religious, if not legal terms.

Mr Woolley, from the firm who specialise in divorce and family law, added, “Both husband and wife need a Get to be able to remarry as orthodox Jews and remain integrated into the Jewish community. A Jewish Beth Din court can issue a Get. The parties have to have ceased living together and be at separate addresses and they also both need to agree to it.”

It Pays To Negotiate In A Divorce

Going to a divorce solicitor does not necessarily mean going to court. It does take two to negotiate a financial settlement however and Woolley & Co, specialists in divorce and family law, advise clients that it pays to negotiate their financial settlement, even if the case does not go to court.

If a client and lawyer together embrace the non-adversarial nature of family proceedings, strive from the outset to keep costs to a minimum and negotiate a reasonable and fair agreement, a spouse can be reasonably confident that the cost of divorce will be restricted to their own legal costs. They can also be confident that their share of the matrimonial ‘pot’ will not be depleted by unnecessary or unreasonable legal fees incurred by the other party to the divorce.

There does need to be a balance between being speedy to keep costs down, but clients should take enough time to ensure the settlement and finances are properly thought through.”

These will protect against accusations of unreasonable dealing with the case and may well be accepted. It is also important to try and remember what the real issue is. It should be making sure you obtain a decent and fair financial settlement and not ‘beating’ your former spouse. If possible, try to avoid matters of principle as these are especially expensive. Battles over points of principle often occur where one or both of the parties are struggling to come to terms with the emotional aspects of the relationship breakdown.

Frequently it costs more to argue the point than the asset in issue is worth.”

The divorce solicitor suggests that parties take the first available opportunity to propose a reasonable settlement and endeavour to keep emotions, and costs, in check. The costs of a case which goes to Court nearly always vastly exceed the costs of a sensible settlement and that ignores the emotional costs too. My husband says I’m a bad mother. Can he get custody?

MYTH: I have to do what my husband says otherwise he can make me out to be a bad mother and take the children off me.

REALITY: Only a court can, legally, remove your children from you. It is not a case of listening to what he claims to be the case, but the court would consider what had really happened, as well as obtaining reports and detailed evidence. Often there is no validity in this claim and in some cases it is simply used as a bullying tactic.

Can I get an annulment if my marriage has never been consummated?

When divorcing, will everything be sorted in one go?

MYTH: Divorce means sorting out everything in one go. That means not just the marriage, but also the house, the kids and all the money issues.

REALITY: That is not the way the legal system works. The word divorce simply means the ending of the marriage in a legal sense. Sorting out other issues connected to that are dealt with separately in a legal sense and may involve court proceedings if the parties cannot agree on arrangements between themselves.

Does the cost of divorce depend on the reasons for divorce?

MYTH: I want to divorce my wife on the basis that we have been separated for two years. Therefore, I don’t need a solicitor and it will be cheaper than if I was divorcing because of unreasonable behaviour or adultery.

REALITY: You may require further advice as to whether you satisfy the criteria to obtain a divorce on two years’ separation. It is not automatic and you will require your wife’s consent.

Woolley & Co speak out for wives on divorce

It’s recently been reported in the Times that family law expert Baroness Deech is calling for an end to the idea that women deserve half of their husbands’ wealth on divorce.

The crossbench peer, who taught and lectured on family law for more than 20 years at Oxford University, accuses judges of developing the law in a “paternalistic and unprincipled fashion.”

Lady Deech says: “The notion that a wife should get half of the joint assets of a couple after even a short, childless marriage has crept up on us without any parliamentary legislation to this effect.” Judges are ignoring the statutory direction to try to achieve a “clean break” between divorcing couples.

“It is no wonder that England is the divorce capital of Europe and out of step with other European countries,” she says.

At Woolley & Co we’ve discussed the issues raised by Baroness Deech’s comment and have some perhaps controversial and contrary views to the esteemed Peer.

Woolley & Co senior Partner Andrew Woolley says: “The view being given is that the wife automatically gets half of marital assets. That clearly is not true – you only have to look at the McCartney case for evidence of that.

“I don’t see it as a gender issue, more an issue of the one with the most money sharing it with the one with the least. That is normally - but not always - the man. That is a consequence of social history.

“The needs of the person with the genuine lower earning capacity have to be considered as a relevant factor by the courts. That could just as easily be the man as the woman although traditionally it has tended to be the female as women tend to take on the role of child carers and often leave work to take on a full time home making role.

“Some of the comments reported seem to suggest discretion should be removed from the courts to make decisions in these cases. It must be right to provide discretion, a one answer fits all approach (as in the CSA) would result in considerably more inequality than there is at present.”

As divorce lawyers Woolley & Co always take into consideration the contribution towards the matrimonial assets (ie pre marriage assets) and this is something the courts also have to (and do) consider when coming to decisions.

Judith Buckland, family solicitor based in Cornwall adds her view; “I think the big money cases muddy the waters on this issue and they are of course what everyone knows about and homes in on without looking at the bigger picture.

“I’ve noticed from the comments on the press coverage that the general feeling is that the wife will always get the home but simply isn’t the true picture. The home is likely to be maintained for the benefit of the children and (because wife is usually the primary carer) the consequence is often that the wife will be able to remain in the house in the short to medium term. The husband will get his share – he just may have to wait for it. Is the inference from Baroness Deech that men should have their rights put before their children’s? I don’t think many would go that far.”

At Woolley & Co we would certainly welcome greater clarity but so much is determined by people rather than process. Family lawyer Karen Agnew-Griffith explains, “A family lawyer when asked “what can I expect to receive as a financial settlement” can only reply “it depends.” It depends on the Judge on the day. It depends on how bitter and entrenched the husband and wife are. It depends on the quality of the lawyer.

“The current situation is so vague and capable of being interpreted in so many different ways that we are all just working through an educated guessing game with no idea what the end result will be in many cases and that is when years of legal experience is so important.

“A marriage contract should be just that. The budget of thousands often spent on dresses and functions prior to a couple tying the knot should include a sum of money set aside to get the contract right.

“If couples are concerned about leaving decisions to the Courts then a pre-marriage contract to decide who gets what if it all goes wrong can provide real protection. This way each party will know what the future holds either way and make decisions including giving up work for a time or not, raising children or not, based on what’s been agreed.”

Can my children see me when they want?

MYTH: My children can decide when they want to see me. I don’t want us all to have to stick to strict timetables on access as it is not practical.

REALITY: In many cases, a couple can decide between them, and with the children, on access times. If the couple cannot decide however the matter is referred to the court. Depending on the ages of the children, their views may be taken into account, but ultimately a judge could decide on the level and pattern of contact. Ideally you need to try and come to an agreement with your partner that suits all of you.

MYTH: My husband and I have separated and he is going bankrupt. However, I have been told I will get the house as I have our young children to bring up.

REALITY: In the event of bankruptcy, the security of the matrimonial home will be threatened and the question will arise as to whether the property should be sold to pay off the creditors. It is therefore not a foregone conclusion that you will be able to retain the house. Could A Prenuptial Agreement Be Beneficial To You?

Prenuptial agreements are often cited in celebrity divorce cases as multi millionaire stars attempt to retain their hard-earned assets in the event of separation or divorce. However, it is not just Premiership footballers and Hollywood A-listers for whom a prenuptial agreement could be beneficial and now, Woolley & Co, specialists in divorce and family law, offer advice on the creation of such an agreement.

A recent case involving the celebrated comedy actor John Cleese identifies how a ‘prenup’ can be crucial in certain cases. Michael Winner, a friend of the Fawlty Towers actor, is reported to have said that if anybody marries Cleese's recent ex-wife they had "better have a prenuptial agreement". These comments were based on reports that she has obtained a massive financial settlement from him which obliges him to pay millions up front to her plus keep working sufficiently to pay her £600,000 per year until he is 72. Cleese himself apparently says "I start to wonder how much it would have cost me if she'd contributed anything to the marriage".

A prenuptial agreement is a document in which a couple set out their rights to any property, debts, income and other assets purchased together or acquired individually or that they have bought into their relationship in the event that the relationship ends.

Andrew Woolley, senior partner at Woolley and Co, who can help with prenuptial agreements as well as getting a divorce says, “A recent landmark case featuring a paper industry heiress ruled that courts will regard prenuptial agreements as binding unless there is a reason not to. Previously, such an agreement was often ignored as the Courts didn't keep to them but from now on we will be advising that it is better to have one than not.”

Cleese is previously well known for settling divorce cases without unpleasant disputes but the recent settlement left a bitter taste. The Monty Python star said, “What I find so unfair is that if we both died today, her children would get much more than mine.”

Children, Divorce - and Custody.

MYTH: I’m not going to fight with my husband over custody because if I do, my kids will have to go to court and they have already been through enough.

REALITY: They will not have to go to court. Court proceedings over which parent the child should live with do involve court hearings but your children would not be required to attend. The Court will often consider reports by welfare officers when making this decision. During the compilation of these reports, the children would normally be spoken to (if they were of an age where they could give an opinion), by the person writing the report but these meetings would normally take place at home, or sometimes at school.

Bankruptcy and Divorce

MYTH: My husband was declared bankrupt before we separated. We still own the family home jointly so I risk losing it in order to pay his debts.

REALITY: If your husband was declared bankrupt, you may find that there are creditors wishing to put a charge against the property in order to recover monies owed to them. Although they have the power to apply for the property to be sold straight away, it may not succeed if you are still resident there, particularly if you have dependant children. As and when the property is sold, money to pay your husband’s creditors can only be taken from your husband’s share of the sale proceeds.

Divorce - The Affects on Children

As necessary as divorce may be for struggling couples, children caught in the middle of a relationship breakdown are often silent victims of the break-up. Now journalist Tina Clough talks to Woolley & Co, the family law specialists, to discuss how parents can help to soften the blow of divorce.

As the recession continues to put more marriages under pressure, many families are expected to find themselves in strained relationships with arguments caused by money worries. In this difficult situation, it’s inevitable that divorce will be considered and may even prove to be the best option for the sake of everyone involved. But, how would a child understand this?

Andrew Woolley, senior partner at family law specialists, Woolley & Co said “Young children cannot be expected to understand that their parents’ divorce is an action born out of necessity and love for the child. It is best to try to reassure them that although things will be different, you will always be their source of stability and love.”

Children often feel that their lives will be changed forever, and that the change is entirely negative. Parents will want to give them the support they need to be able to adapt to the challenges ahead. Talking to them and allowing them to ask questions will help them to feel secure in their relationship with you, and will show them that you have confidence and authority in your decision to divorce.

Offering physical support is also a key factor in helping your child to deal with the trauma of getting a divorce. Sitting down together, going for a walk or a simple hug does wonders for a child and will help to keep them stay strong in this difficult time.

Mr Woolley added, “It is also vital that the child, regardless of their age, understands that the causes of divorce are no way linked to their own behaviour. Often children feel as though they are the cause for the break-up, even though they may have been assured that is not the case. It is very important that youngsters are clear on this point, and that you let them know that even though you are going through a tough time and a wide range of emotions, you are not blaming the child for this.”

Another point to remember is to keep it simple. Do not overload your child with details of new living arrangements unless they are confirmed and agreed with your spouse, as it may confuse them. Teenagers will ask a plethora of questions, but try not to divulge information that is not certain.

Mr Woolley added, “Conflicting information can be a side-effect of a divorce where the parents cannot successfully agree on important details such as living arrangements and child contact, which can adversely affect the relationship between parent and child. How To Lose Your Spouse But Not Your Mind With Woolley & Co

As new figures released by Relate, the UK based charity offering relationship counselling, reveal a 66 per-cent rise in the demand for their services as the impact of the recession begins to takes its toll on many couples, the family law specialists at Woolley &Co are launching their top ten tips for surviving both divorce and the financial turmoil.

Andrew Woolley, senior partner at “virtual” law firm Woolley & Co, which conducts much of its work online and over the phone, said, “The scenario is all too well known. You didn’t know there was anything wrong. Your spouse tells you they have another and are moving in with them, that they want 60 per-cent of the house, the children, the car, part of your pension and a large part of your business. And you’ll get divorce papers in the next week setting out your unreasonable behaviour!"

In light of this all to common scenario Woolley & Co, solicitors have developed their top ten tips for survival:

1. Don’t underestimate how tough it will be. Without the right advice it will be slow, painful and costly. If you are the one with most assets in your name or under your control it will feel more like damage limitation than “doing quite well out of it”. Get a good divorce lawyer fast and listen. But don’t (normally) do anything immediately. Reflect. Speak to a friend who will tell you the truth, one who won’t just tell you that you are right and your spouse is an absolute....... (They may be, but will that help?) Consider counselling, it really helps get things in perspective. Get ready for a long battle, unless of course you are prepared to come to an agreement. This isn’t the necessarily wrong thing to do.

2. Hide your assets. No, no, no! It very, very rarely works and is normally found out. If found out you are in trouble. Courts can effectively ignore and turn back transfers to friends or children; giving up a job or running the business down. They’ve heard them all before.

3. Get a good divorce lawyer. This is very important. Ask around. Look at websites; do they sound your sort of people, can they communicate with you, are they experts, do they immediately suggest Court (if so, worry about them), do they talk about seeking an agreement?

4. Think about the legal costs. They can be huge but not normally anywhere as high as the cost of divorce that you can sometimes read about. And the large bills are normally only if your case ends up being decided by the Court in a long hearing with nobody even able to agree what day it is. Do try to avoid that and the best way is to swallow pride and ideas of retribution, focus instead on what you are trying to achieve.

5. Don’t spend £100 arguing about £100. What is the point? Think about it. If you both do that, you’ve spent £200 arguing about £100. Someone has to be the “adult”, let it be you. You will feel better in the long run.

6. Stay in the house. OK, not if you are in danger but normally it is by far the best to stay as you will know much more about what is happening. If a sale is to happen then you will be able to see if your spouse is trying to put buyers off, and if they are going to buy you out, your presence is an incentive to get on with it!

7. Don’t agree with a new lover that you will remarry or live together. Avoid the subject and keep it out of your mind. Just in case. If the case does go to Court then if asked as you will likely be “Do you have any present intention to remarry or cohabit” you can honestly then answer “no”. And anyway, it is just too soon for you to make that sort of decision.

8. Sort disputes over the children out without lawyers if you can. The only real alternative to an agreement is a rigid Court order, obtained at great expense. It is rigid for both you and the spouse too and it often doesn’t work due to realities of varying needs, time, delays and so on.

9. Change your email address. Well, maybe don’t go that far but change the password to your email account so your spouse can’t see the legal advice you are getting. It is incredible how often this happens.

10. Try to be as honest as you can. Especially to your own divorce lawyer. But many people are surprised to find their lawyer will not lie for them and often cannot continue advising them if told “Don’t tell my spouse but I’ve got £10,000 under the mattress”.

Family Law Firm to Dispel Myths Fuelled By Celebrity Splits

High-profile celebrity break-ups are fuelling common myths about divorce and sending the wrong messages to struggling couples, leading family law specialist Woolley & Co has warned.

Celebrities such as Katie Price and Peter Andre, Madonna and Guy Ritchie, and Kym Marsh and Jack Ryder have all been embroiled in divorces this year, bringing legal separation issues into the headlines, but all the talk of “quickie divorces” and generous settlements is prompting more couples to have unrealistic expectations of divorce.

Andrew Woolley, senior partner at the virtual law firm, said, “Taking Jordan and Peter as an example, the reports are suggesting that rather than waiting the usual six months, the couple has asked the court to speed up proceedings in order to get a divorce finalised in as soon as a month. That will not and cannot legally happen under English Law. It is giving people false expectations and the headlines about celebrity divorces are a world away from the detail of the situation.

“Whilst they might get the decree nisi agreed quickly, everyone has to wait the same length of time – six weeks and one day – before the decree absolute can be applied for. That is the law, so a quickie divorce is a fallacy.”

High profile couples often agree on the finances outside of court in order to keep things moving as quickly as possible and to avoid getting bogged down in discussions in court. Dealing with them away from the glare of media attention is also preferable to many celebrity couples.

The same rules apply to the average couple, but they might not be so reticent to go to court if an agreement cannot be reached, which can make a divorce take longer. Expectations can be set unrealistically, and many in the process of divorce believe that they can get a mythical quickie divorce and want to know why their case is dragging on.

Mr Woolley added, “The divorces of these celebrities may sell papers and people do have a fascination with them, but they are of little real relevance to the normal person. We need to do all we can to diffuse these myths to enable couples to manage their own divorce in the most appropriate way – and that always starts with finding a divorce lawyer or at least taking professional advice from an experienced family lawyer who will explain the process to them.”

In a bid to dispel some of the myths surrounding divorce, Woolley & Co is to publish a book on the subject, tackling such issues as “common law” man and wife as well as myths such as “the children always go with the mum” and “she always gets the house”. 101 Myths about Divorce and Separation will be available in September.

With the number of unmarried couples reaching an all time high, comes an increasing number of disputes in Court when those couples separate. There are no precedents or law that governs how these matters should be dealt with and although there are some landmark cases that offer some guidance, cohabitation remains a relatively grey area.

A cohabitation agreement (also known as a living together agreement) captures the terms of agreement the parties wish to be bound by when embarking on their life together. It can detail the assets each party is bringing to the relationship and what they can expect or intend to leave with. It can also detail what you intend to happen if you subsequently have children.

Ultimately, if you and your cohabitee were to separate and then start arguing over who get’s what the cohabitation agreement could be used by the Courts as guidance to show your intentions at the time of entering into the relationship. The Court does have discretion in deciding whether to enforce it or not. But essentially if the document has been properly drafted and each party was frank about their position at the time of the agreement being drafted, you stand a better chance of having it enforced meaning less costs incurred and the possibility of avoiding proceedings altogether.

For those of you who are about to make the big step into married life, Woolley & Co can help you to arrange a prenuptial agreement. We’ve all heard of them but most of us don’t have one and probably don’t even know anyone who has. They’re generally far more popular in the USA where they’ve been around longer and are watertight, but they are on the increase in the UK too.

They are similar in format to cohabitation agreements. People have shied away from them in the past as it was thought they weren’t legally binding. The fact is, a Court of Appeal ruling in July 2009 means prenuptial agreements are more likely to be seen as binding. A Judge will give consideration to the terms of the prenuptial agreement and the intentions of the parties at the time it was drafted.

Similarly, post nuptial agreements are also growing in popularity. These are very similar in format to prenuptial agreements but are entered into after marriage rather than before. They deal with the difficult issue of the division of assets and money were the marriage to come to an end. A relatively new concept, they are now considered to be fully binding in the UK after five law lords clarified their position in English law shortly before Christmas 2008. As with prenuptial agreements, both parties must be upfront and honest about their financial position at the time the document is prepared and the agreement itself must be properly drafted. Assuming that to be the case, these agreements will be binding even if they reflect something different to what a Court may have ordered. If you go down the matrimonial route and it doesn’t work out you will probably end up separated or divorced.

To protect your wealth you need qualified legal advice on the options of divorce or legal separation and the pro’s and con’s of sorting things out quickly or waiting. Many factors have to be taken into account. For example, you could be receiving spousal benefits from your spouse’s pension while you’re still married. This would come to an end on divorce. Alternatively it could be that you want to try and end or limit your spousal maintenance liability upon divorce.

Divorce - by email?

Divorce is tough enough without unnecessary delay. I think the failure or refusal of many lawyers and many Courts to use email causes huge amounts of that delay.Just think; a letter takes what......3 days if you're lucky to get from the mouth of the creator of it to the recipient. (Dictation, waiting for typist, waiting for signature, ooops just missed the post, delivered 1 or 2 days later). An email takes seconds.

I pause just to make it clear that any divorce will take weeks due to statutory waiting periods and that the lawyer also needs preparation and thinking time--but that time is the same whether by email or letter. So, letters just add to the time taken.

I reckon, from a quick check, that in the average divorce there are about 22 letters in and out. That is from and to the client, other lawyers and Court.

Sending all these by letter takes a total of 66 days! That is, please note, 2 months and 1 week!
Sending all these by email would take 66 minutes at the very, very most. 2 months and 1 week saved from the length of the average divorce. Oh, and it is cheaper for all the people involved.

So, what is the problem?

Time for the Government to make Courts use email and for the Law Society (SRA) to require divorce lawyers to use email as the normal method of communication.

Breaking up is hard to do – whether you are Katie and Peter or Mr and Mrs Average

As the headlines continue, following the announcement that Peter and Katie are getting a divorce, what the press are failing to note is how similar the issues that they face are to all those many thousands of ordinary people experiencing divorce or relationship breakdown.

Of paramount importance in all situations of divorce and relationship breakdown is the welfare of the children. Katie and Pete have two children together, Junior, three and Princess, one. Pete is also step-father to Kate’s son Harvey, aged 8. No doubt they will do all they can to minimise any disruption to their children’s lives. With regards to Junior and Princess, Pete will have parental responsibility which means he is recognised in the eyes of the law as having all the legal powers to make appropriate decisions in relation to the upbringing of the children. He will not automatically have gained parental responsibility for Harvey unless such an agreement was entered into.

It is alleged that the couple have been in meetings to discuss arrangements for their children and the latest news is that Katie wants a quickie divorce.

Deciding how best to look after the children will hopefully be their overriding priority. It is usual to try and keep the children settled in the family home wherever possible to minimise disruption to their daily lives. Let’s hope Pete and Katie can settle this issue amicably.

Whether parties do reach an amicable agreement or legal intervention is required it’s advisable to obtain legal advice from an experienced family solicitor to draw up a formal agreement. This should ensure that each party is clear about their responsibilities, misunderstandings do not arise and lead to conflict.

Much has been made in the media of a potential court battle over the couple’s joint fortune. It has been reported that Pete insisted on signing a prenuptial agreement prior to their wedding. This is a document in which a couple can set out their rights in relation to any property, debts, income and other assets purchased together or acquired individually, or that they have brought into a relationship. Once you are married, all assets become matrimonial assets and, unless protected, they are thrown into a single financial pot. Prenuptial agreements can be highly influential in any decision on assets, if not strictly binding, as judges are increasingly minded to take account of properly drawn up agreement.

The financial settlement can sometimes be the most contentious part of the divorce proceedings, particularly if, as in Pete and Katie’s case, large sums of money are involved. Take advice from an experienced family law solicitor who understands the complex legal issues involved. It seems Katie at least is already taking advice – allegedly having appointed the same solicitor used by Sir Paul McCartney in his divorce case.

Although Mr and Mrs Average may not be conducting their relationship breakdown in the public eye and are unlikely to have the same financial assets as Katie and Peter they still need advice and they need to carefully consider what is best for themselves and their children. Let’s hope Katie and Peter get good advice, conduct themselves with dignity and that their children come out unscathed.

Parental Responsibility and Contact Orders

As in our previous article about Parental Responsibility (see Parental Responsibilty – Do you have it for your child?’) Parental Responsibility is defined in law as ‘all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his property’. In essence, this is the law officially recognising you as your child’s father and giving you the same rights as any other parent. But what does this mean and how specific is it? This is what causes confusion for fathers who have just obtained or are considering obtaining Parental Responsibility for their child.

Obtaining Parental Responsibility for your child puts you on an equal basis with mother and gives you the legal right to have a say in your child’s upbringing. It is sadly often the case that a break-up between parents often becomes so acrimonious that the children are used as tools to hurt each other. Therefore if you wish to have a say in your child’s upbringing it is always a good idea to obtain Parental Responsibility. It doesn’t generally deal with day-to-day issues but can include the right to be consulted on such issues as where your child goes to school, consenting to medical treatment and even religious issues which may affect your child. Of course plenty of couples separate on an amicable basis and put arrangements in place by agreement between them and so Parental Responsibility is not raised as an issue.

Having Parental Responsibility also gives you the legal right to see your child. However, it does not guarantee that you will get contact with your child, although it is usually considered the first step towards it. The two are separate issues and therefore, must be treated as such.

If you find yourself in the unfortunate position of being denied the opportunity to see your child then you will require the Courts to make a Defined Contact Order. This can determine how often and where you see your child based on the circumstances of the case and a checklist of other factors, such as any previous contact that has taken place, where the parties live, the ages of the children and (depending on their age) the views of the children. The Courts will make a decision based on what they consider to be in the child’s best interests. Plenty of unmarried fathers have obtained Contact Orders for their children in the past so the issue of Parental Responsibility is not necessarily a deciding factor, although most applicants tend to apply for Parental Responsibility at the same as they apply for a Contact Order.

Of course, it is hoped that most parents do not need the intervention of the Courts in order to agree arrangements and contact with their children can often be agreed between them without the issue of Parental Responsibility cropping up. However, it is important for all fathers to remember (even those married to mother previously) that Parental Responsibility means lots of different things and provides rights on various issues as detailed above. But it does not guarantee that you will get contact with your child. If no agreement can be reached voluntarily with mother then a separate application must be made to the Court for a Contact Order.

Protecting Your Children When A Relationship Breaks Down

Couples can often decide to go their own ways but not immediately feel the need to push for a divorce. This could be for any number of reasons and each case is unique, but it does leave both parties in limbo somewhat, unless inroads are made to clarify the legal standing of the relationship, and so leading family law firm Woolley & Co. are making an effort to warn separated couples of the problems of leaving it to chance.

The lack of a formally drawn up legal separation agreement can lead to quarrels over household bills, possessions and how best to deal with joint assets. However much couples trust each other and part on good terms, doubts and problems will inevitably arise. Things get particularly tricky when children are involved, and even if you trust each other as far as finances go the emotionally charged nature of the situation can turn things sour.

Andrew Woolley, Managing Partner of the award winning family law firm, believes that for the wellbeing of children a legal separation agreement is a must for couples in this situation. He said, “While of course marital breakdown and divorce put a huge strain on everyone involved, such times affect children more than anyone else.

“This is why, even if the relationship ends on good terms, a legal separation agreement is a must to ensure consistency for, and the protection of, young children. At the very least anyone experiencing such a breakdown should consult an experienced family lawyer to find out further about the pitfalls of separation.”

A legal separation agreement, also known as a Deed of Separation, records from the start who is to have what and what the parties’ responsibilities are, and can therefore help avoid
the need for court proceedings at a later stage. When preparing to draft the separation agreement, each party must produce full and frank financial disclosure, showing documentary evidence of their assets and liabilities. Each party exchanges this information with the other, and then a discussion takes place – and hopefully an explicit separation agreement can be drawn up. If a couple can agree things between themselves, although family law professionals do need to be involved, their involvement, and so the cost, can be minimal, and this is true of both a legal separation agreement and a divorce.

Easter Warning For Step-Parents

Hundreds of children across the country could be left without anyone legally in charge of them this Easter because step-parents do not automatically have the right to make important decisions in the event of an emergency, family law firm Woolley & Co has warned.

Many families split by divorce will see the children visiting both sets of parents over the school holidays – but many are unaware that legally some parents and their partners do not have parental responsibility, and so are not permitted to give permission for things like hospital treatment in the event of an emergency.

Andrew Woolley, Managing Partner of Woolley & Co, who specialise in all areas of family law, divorce and legal separation, said, “On a practical level, having parental responsibility will, amongst other things, allow you to contact your child’s GP to obtain or discuss medical treatment for your child and to play an active role in your child’s education, giving you access to school reports, parents evenings, and that sort of thing.

“In most instances this is not a huge issue and that is why it is not something that many people are particularly aware of. However it comes to the fore at times like school holidays when a child might spend more time with the parent they do not ordinarily live with. The father may not have automatic responsibility, and if they have a new partner, they almost certainly won’t unless they have consulted a family lawyer and put in place a special agreement.”

Parental responsibility is defined as “all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his property.” A
mother automatically has parental responsibility for her child, as does a married father, irrespective of whether the marriage to the mother occurred before or after the birth of the child. As from the 1st December 2003 unmarried fathers of children born after this date, provided they are named on the birth certificate of the child, also have parental responsibility. So fathers whose son or daughter is more than five years four months old, who are not married to the child’s mother and not on the birth certificate, may not be able to take important decisions for their child if the mother is absent.

If you are a father who does not have parental responsibility there are several ways it can be obtained. Firstly parental responsibility can be obtained by marrying the mother of the child, however of course this is not always an option. There are other ways of securing parental responsibility, all of which require the expertise of a qualified family lawyer. You can either enter into a voluntary Parental Responsibility Agreement with the mother, or obtain an order of the court (Parental Responsibility Order). Both of these routes can be facilitated by a family lawyer.

Ultimately you hope that the most important parental responsibilities will never come in to play, particularly ones regarding medical treatment, but if you are at all concerned about your rights as a parent you are advised to consult a family law expert to ensure you are fully aware of your position within the law.

Lightweight excuses for divorce prompt call for “no fault” option

Not fixing the loo door, regularly passing wind, not doing the ironing and insisting that the cats and dogs sleep in the marital bed are among the “unreasonable behaviour” details cited by people when seeking a divorce, a poll of solicitors has revealed.

Family law specialists Woolley & Co. revealed that among its clients from the past two years, unreasonable behaviour is the most common reason given for the breakdown of a marriage in the UK – but the current finger-pointing divorce system forces estranged couples to go further and give specific reasons why they don’t want to stay together.

The firm, who have been dealing in issues of family law, such as divorce and legal separation, for over ten years, encourages its own clients not to inflame divorce proceedings by choosing grounds which their partner might choose to argue against, but instead to seek a non-confrontational approach to ensure the process is as quick and painless as possible.

Andrew Woolley, Managing Partner at Woolley & Co, who has family law experts across the Midlands and South, believes a change in the law to allow a no fault divorce could cut the cost and heartache for thousands of couples divorcing each year, rather than setting them at loggerheads.

Pre-Nups – Know Your Rights Before Tying The Knot

If you are paying spousal maintenance or child maintenance under the terms of a court order then it is important that you do not ‘take matters into your own hands’ and simply stop payment. This could result in a court order being made against you for all of the missed payments and the court costs in addition. The first port of call is to try and speak to your ex partner to see if they will agree a reduction, if so, you then need the advice of an experienced family lawyer to ensure this agreement is legally binding and formally recorded.

It is also important to remember that you cannot just expect to reduce the payments because your costs of living have risen. Unlike married couples, unmarried partners do not have the legal parameters of marriage to govern issues such as house ownership (especially when one of them already owns a house) and their finances during and after the relationship.

Mr Woolley added, “Normally the most significant asset of any partnership is the house and once you have decided to go your separate ways, the starting point is often to consider whose names are on the deeds to the property. There are some circumstances which may allow you to claim an interest in your former partner’s home, for example if it is the family home for children, or if you have paid towards it – but this is a complicated area of law and it is very important to get some advice from a family law expert on your particular situation.”

If you were not married to each other, the contents of your house can also end up being the fuel that lights the fire. The basic rule is that each item belongs to whoever paid for it, but in some cases couples will be able to agree that it would only be right for example, that whoever any children live with should have the use of the majority of items. Wishes such as these can recorded in a Living Together Agreement to settle any disputes, which may arise later.

“We encourage couples to take six steps before considering the help of a divorce lawyer. January can often bring a stampede of couples who began having difficulties over the Christmas period. There are so many potential strains over Christmas that it can put stress on even the strongest relationship.”

Steps to take before contacting a divorce lawyer include:

STOP! Do you really want to take this step in the relationship? Maybe you can both go to a relationship counsellor, ask your religious leader to help, read the Relate website or take other steps to save the situation. That said when a person is known to have spoken to a divorce lawyer, it allows the other person in the relationship to realise how serious they are and that can cause a major change in them. But do think carefully, first. It is important to bear in mind that a good family and divorce lawyer will aid your understanding of the options available. Any one in this situation should realise that calling a divorce lawyer doesn’t mean you have to take it any further, it just means you have access to information and advice so that you can make an informed decision.

ASK people you know which divorce lawyer they used and what their views were. All divorce lawyers are qualified in a similar way but you will need to find one who specialises in family law or divorce law. Looking on the Web is a great idea to find a lawyer who really looks like they specialise in family law rather than say they do. If you can understand their website you will probably understand them. Do they offer fixed fees and/or do they tell you how much they charge? All these are very good signs.

CONSIDER what you are really trying to achieve. Maybe you would like to have some counselling or “divorce coaching” to help you with that. Many people, perhaps understandably, go to divorce lawyers insisting upon what is really vengeance. Courts are very, very expensive places to attempt to mete out any form of punishment to a former spouse. Try to avoid this unless you want a legal bill of the huge figures one sometimes reads about.

PREPARE your papers and figures. Make a note of your view of the valuations of valuable items such as house, car and investments. Try to get papers together on pensions, savings, bank accounts and salary for both of you. The more information you can provide, the more detailed advice you will receive at an early stage.

DON’T agree anything, formally or signed, with your spouse. That will come soon enough. Quite often we see cases where a dominant partner has pushed the other into a proposed financial settlement that is very, very unwise indeed. Listen to what they say by all means but find out what the traps are for the unwary, first. If you have already come to an agreement, do tell your divorce lawyer. Nobody will stop you going through with it provided you understand it. Divorce lawyers are only there to advise, not to tell.

CHECK you can have an informal talk to your proposed divorce lawyer before you are committed. Can they communicate with you? Do you understand them? Do they seem understanding and knowledgeable? If not, go somewhere else. The vast majority of complaints about divorce lawyers are about failure to communicate properly and not about legal ability. It does not matter how technically good they are and how many certificates they have if they can’t help you understand what is happening.
